Terms of Use

These Terms of Use ("Terms") govern your access to and use of the CaloriePath iOS application ("the app", "the service"). By installing or using the app you agree to these Terms. If you do not agree, please do not use the app.

Important — not medical advice. CaloriePath is a wellness tool, not a medical device. Calorie estimates, walking targets, and AI-generated insights are general guidance and may be inaccurate for your particular situation. Always consult a qualified healthcare professional before changing your diet, exercise routine, or treatment for any condition. If you are pregnant, recovering from illness or surgery, have an eating disorder, diabetes, a heart condition, or any other medical concern, do not use this app as a substitute for professional advice.

1. Eligibility

You must be at least thirteen years old to use CaloriePath. If you are under the age of legal majority in your jurisdiction, you must have a parent or legal guardian's consent to agree to these Terms.

2. Your account

You sign in using Sign in with Apple or Sign in with Google. You are responsible for keeping the underlying Apple ID or Google account secure.
You agree to provide accurate information and to keep it current.
You are responsible for activity that occurs under your account.
You may delete your account at any time from inside the app via Profile → Delete Account. Deletion is permanent.

3. Your content

The wellness data you log in CaloriePath — meals, walks, profile fields, photos used for barcode scanning — is yours. By using the app you grant CaloriePath the limited licence necessary to store, sync, display, and process that content for the sole purpose of running the service for you. We do not claim ownership of your content.

4. Acceptable use

You agree not to:

Use the app in a way that violates any applicable law or regulation
Reverse-engineer, decompile, or attempt to extract the source code, except as permitted by law
Use automated systems (bots, scrapers) to access the app or its backend
Probe, scan, or test the vulnerability of the app or interfere with its operation
Submit content that infringes any third party's intellectual property or privacy rights
Use the app to harass, abuse, or harm another person

5. Premium subscriptions

CaloriePath may offer optional auto-renewing premium subscriptions for advanced features. The following terms apply only if and when you purchase a subscription:

Title and length — the subscription title (for example, Premium Monthly or Premium Annual) and renewal period are shown clearly inside the app at the time of purchase.
Price and billing — the price for each renewal period is shown at purchase time. Payment is charged to your Apple ID at confirmation of purchase.
Auto-renewal — subscriptions automatically renew unless turned off at least twenty-four hours before the end of the current period. Your account will be charged for renewal within twenty-four hours prior to the end of the current period.
Manage and cancel — you can manage and cancel your subscription in your iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current paid period.
Refunds — refunds are handled by Apple under the standard App Store policy. CaloriePath cannot issue refunds directly.
Free trials — if a free trial is offered, you must cancel at least twenty-four hours before the end of the trial to avoid being charged for the first period.

6. Health and safety disclaimer

CaloriePath provides general wellness information and does not provide medical advice. The app's calorie estimates, walking targets, AI insights, and recommendations are not a substitute for diagnosis, treatment, or advice from a qualified healthcare professional. Use the app at your own risk. Stop and seek medical attention if you experience chest pain, dizziness, shortness of breath, or any other symptom while exercising.

7. Intellectual property

CaloriePath, its design, code, content, name, and logo are owned by us and are protected by copyright, trademark, and other laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to use the app for your personal, non-commercial use.

8. Third-party services

The app integrates with services from Apple, Google, Mixpanel, Sentry, Open Food Facts, and others, as described in the Privacy Policy. We are not responsible for the availability, accuracy, or content of these third-party services, and your use of them is governed by their own terms.

9. Disclaimer of warranties

The app is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the maximum extent permitted by applicable law, CaloriePath, its developers, and its third-party providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your use of or inability to use the app, (b) any conduct or content of any third party on the app, or (c) unauthorised access, use, or alteration of your transmissions or content. In no event will our total liability exceed the greater of one hundred United States dollars or the amount you paid us in the twelve months preceding the claim.

11. Termination

You may stop using the app at any time and delete your account from within the app. We may suspend or terminate your access if you violate these Terms or applicable law, or if we discontinue the app. Upon termination, the licences granted to you end immediately.

12. Changes to these Terms

We may update these Terms as the app evolves. Material changes will be announced inside the app or via the email address associated with your account, and at the top of this page. The "Last updated" date always reflects the current version. Continued use of the app after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the app shall be subject to the exclusive jurisdiction of the courts of Tokat, Türkiye, except where applicable consumer law gives you the right to bring proceedings in your local courts.

14. Apple-specific terms (App Store)

If you obtained the app through the Apple App Store:

These Terms are between you and CaloriePath, not Apple. Apple is not responsible for the app or its content.
The licence to use the app is non-transferable and limited to use on Apple-branded products that you own or control.
Apple has no obligation to provide maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple will have no other warranty obligation with respect to the app.
Apple is a third-party beneficiary of these Terms and may enforce them against you.
